NOTICE IS HEREBY GIVEN
that the TOWN COUNCIL of the Town of Los Gatos has scheduled a public hearing meeting on TUESDAY, APRIL 17, 2018, at 7:00 p.m. in the Council Chambers, Civic Center, 110 East Main Street, Los Gatos, to:

*Adopt a resolution making determinations and approving the reorganization of an uninhabited area designated as Linda Avenue No. 5, approximately 0.21 acres on property pre-zoned R-1:8, located at 15933 Linda Avenue. APN 523-25-023. Annexation Application AN18-001. PROPERTY OWNER/APPLICANT: Sara Seyedin. PROJECT PLANNER: Sean Mullin.

Any item marked with an asterisk (*) is on the consent calendar. The Town Council will sometimes act on items on the consent calendar in one motion. Before the Council acts on the consent calendar, any person wishing to have a consent item discussed may request that the Town Council remove it from the consent calendar and it will be heard under the New Public Hearing section of the agenda. Requests for discussion made after action on the consent calendar cannot be considered.

Information concerning the above application is on file in the Community Development Department at 110 E. Main Street, and available for public inspection during regular public counter hours 8:00 a.m. to 1:00 p.m., Monday through Friday; and the Town Library, 100 Villa Avenue, during regular business hours.

The staff report to the Town Council will be available for public review three days prior to the meeting in the Community Development Department and Town Clerk’s Department at 110 E. Main Street; the Town Library, 100 Villa Avenue, during regular business hours; and on the Town’s website at www.losgatosca.gov.

All INTERESTED PERSONS are encouraged to appear at the Public Hearing and be heard. If anyone wishes to challenge the action on the above application in court, they may be limited to raising only those issues they or anyone else raised at the Public Hearing described in this notice, or in written correspondence delivered to the Town Council at, or prior to, the Public Hearing. Sealed proposals will be received at the office of the Town Clerk of the Town of Los Gatos, 110 E. Main Street, Los Gatos, CA 95030, until 2:00 PM, THURSDAY, April 12, 2018 for the following project:

Project #17-831-3104 Bachman Park Rehabilitation (Landscaping Upgrades)

at which time they will be publicly opened and read aloud. Sealed proposals must be clearly marked on the outside with the Project name or number, date, and time of bid.

This following information is presented to indicate the size of the project and no warrant is made or intended as to final quantities:

The project includes clearing, grubbing, placing mulch, overseeding grass, planting bushes and trees, installing rip rap, relocating backflow preventers, regrading around park benches, relocating an irrigation controller box, and maintaining landscaping for 90 days in Bachman Park in the Town of Los Gatos.

All contractors and subcontractors have been required since April 1, 2015 to be registered with the Department of Industrial Relations (DIR). No contractor or subcontractor may be listed on a bid proposal or may work on a public works project unless registered with DIR.

All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). For additional information, visit the DIR website at: http://www.dir.ca.gov/Public-Works/PublicWorks.html.

Each bid must be accompanied by a cashier's check, certified check, or Bidder's Bond executed by a corporate surety authorized to engage in such business in the State of California, payable to the Town of Los Gatos, in an amount not less than ten percent (10%) of the amount of the Base Bid. The successful bidder will be required to furnish a Performance Bond in an amount equal to one-hundred percent (100%) of the contract price, and a Labor and Material Bond in an amount equal to one-hundred percent (100%) of the contract price. Said bonds shall also be executed by a corporate surety authorized to engage in such business in the State of California and be made payable to the Town of Los Gatos. Original Bidder’s Bond with surety seal must accompany the bid.

If the successful bidder fails, neglects, or refuses for TEN (10) calendar days after the award of the contract to enter into the contract to perform the work, the cashier's check, certified check, or Bidder's Bond accompanying the bid and the amount therein named, shall be declared forfeited to the Town and shall be collected by it and paid into its general fund. No bidder may withdraw his/her bid for a period of SIXTY (60) calendar days after the date set for the opening thereof, and the same shall be subject to acceptance by the Town during this period.

The Town reserves the right to reject any or all bids, waive any irregularities in any bids and its determination as to which bid is the lowest responsible bid and is for the best interest of the Town shall be final. The Town shall have SIXTY (60) calendar days from and after the opening of the bids within which to make its determination.

The Contractor receiving the award of the contract shall begin work within FIFTEEN (15) calendar days after receipt of the Notice to Proceed and shall diligently prosecute the same to completion within the time restrictions as listed in the technical specifications and all work shall be completed by the time allotted in the technical specifications.

The Contractor shall have twenty five (25) working days to complete this project. Working days will be counted upon the Contractor’s receipt of the Notice to Proceed, as noted above.

At the time the Contractor’s bid proposal is submitted, the Contractor shall possess a valid Class A or Class C-27 California Contractor’s License. The Contractor shall also possess a valid Town of Los Gatos Business License at the time the contract is awarded.

The Town of Los Gatos hereby notifies all bidders that it will affirmatively insure that the contract entered into pursuant to this advertisement will be awarded to the lowest responsible bidder without discrimination on the grounds of race, color, national origin, sex, religion, age or disability. The Contractor or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR, Part 26 in the award and administration of DOT-assisted contracts. Failure by the Contractor to carry out these requirements is a material breach of this contract, which may results in the termination of this contract, or such other remedy as recipient deems appropriate.

Prevailing Rate of Wages: In accordance with the provisions of the California Labor Code, the Town Council hereby determines that the general prevailing per diem rate of wages in the Town of Los Gatos, for laborers and for each craft or type of worker and mechanic employed in the execution of the contract, is the Union Wage Scale established for Santa Clara County, which wage scale as of the execution date of the contract is incorporated herein as if fully set forth. Overtime shall be not less than one and one-half (1-1/2) times the established rates. Sundays and holidays shall be not less than two (2) times the established rates. In payment of labor, the Contractor shall comply with the provisions of Labor Code Sections 1770 to 1781 inclusive (Article 2, Chapter 1, Part 7, Division 2), and any acts amendatory thereto.

For any moneys earned by the Contractor and withheld by the Town to ensure the performance of the contract, the Contractor may, at the Contractor's request and expense, substitute securities equivalent to the amount withheld in the form and manner and subject to the conditions provided in Article 8, (commencing with Section 10263), Chapter 1, Part 2, Division 2 of the Public Contract Code of the State of California.

This following information is presented to indicate the size of the project and no warrant is made or intended as to final quantities:

The project includes the removal and installation of colored concrete pathways, new colored sidewalk, retaining walls, and curb ramps at Bachman Park in the Town of Los Gatos.

A portion of this project is funded by federal funds and therefore is subjected to federal guidelines as noted in the Special Provisions. The Contractor shall be responsible for complying with the federal requirements and for completing and submitting all necessary forms required under this contract.

Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts will be enforced. In the event of a conflict between Federal and State wage rates, the higher of the two will prevail.

The Contractor’s duty to pay State prevailing wages can be found under Labor Code Section 1770 et. Seq. and Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and employ apprentices including forfeitures and debarment.

This is a United States Department of Housing and Urban Development (HUD) Section 3 contract. First preference will be given to a bidder who provides a reasonable bid and is a qualified Section 3 Business Concern. Second preference will be given to a bidder who provides a reasonable bid and commits to achieving the Section 3 employment, training and subcontracting opportunity goals.

The project includes traffic signal modifications and intersection improvements at the intersection of Santa Cruz Avenue/Blossom Hill Road/Mariposa in the Town of Los Gatos. Work includes, but is not limited to, installation of a new traffic signal foundation and pole, modification of existing traffic signal equipment and installation of thermoplastic crosswalk pavement markings, as shown on the plans.

Per Town Code Section 14.10.075, a forth 25% late penalty will be assessed on May 3, 2018 if payment is not received by May 2, 2018. A business which fails to renew or disclose that it no longer operates within Town limits may be forwarded to a collection agency.
